One-time colleagues : ServeNow.com: "In Bay County District Court on Monday, a deputy who once upheld security in the building sat in an orange jumpsuit and shackles as several former colleagues took the stand to testify against him.

Dale Van Wert, 48, of Garfield Township, has pleaded not guilty to 11 felonies and four misdemeanors stemming from allegedly operating his private process-serving company while on duty at the Bay County Court Facility from February to June of last year.

Additional charges alleging that he sexually assaulted a 13-year-old girl in December - charges that carry, upon conviction, penalties of up to life in prison - also are pending against Van Wert, though those charges weren't addressed in Monday's hearing.

Prosecutors allege that Van Wert misused his authority as a deputy to obtain information on people and vehicles to facilitate the operations of his business, Court Service Integrity.

While the Bay County Sheriff's Office often has a deputy serve court papers while on duty, the fees, which range from about $12 to $40, go to the county's general fund. It's against county policy for deputies to serve papers in Bay County outside of their capacity as public servants. "

cbs2chicago.com - Saint Served Paternity Papers In Chicago: "New Orleans reserve linebacker Danny Clark was served papers in a paternity lawsuit involving a Chicago-area woman after the Saints arrived at their hotel for today's NFC championship game.

A private investigator gave Clark the papers last night while he was getting into a sport utility vehicle outside the team's downtown hotel.

Clark wasn't available for comment before the game.

Alisha L. Pate claims Clark is the father of her three-week-old son. Pate's attorney says Clark's arrival in Illinois was the first opportunity to serve him.

Saints spokesman Greg Bensel says the team is aware of the lawsuit, but has no comment."

Jail getting new employee

American News | 01/03/2007 | Jail getting new employee: "An increased workload means a new employee at the Brown County Jail.

County commissioners Tuesday approved a new full-time clerical worker for the jail. Among other things, the worker will administer court-ordered breath tests to people on probation or involved in the judicial system and help with fingerprinting and issuing pistol permits.

Sheriff Mark Milbrandt gave the commission information that showed, on Dec. 20, the jail administered 146 breath tests to make sure people hadn't been drinking.

Other work has increased too.

Milbrandt said the county now issues pistol permits for both the city of Aberdeen and the county. When it handled pistol permits for only the county, about 100 a year were issued. Last year, including city numbers, 545 were issued.

The amount of legal paperwork has also increased, Milbrandt said. According to Milbrandt's numbers, the number of warrants received in 2006 was 2,941, up 412 from the year before. The number of civil papers served last year was 4,735 - 370 more than in 2005."

Trial watchers said the subpoenas make it clearer than ever that Libby's defense team will seek to put the Bush administration and its policies on trial."

Former Cumberland resident Kozlowski, 60, was served Thursday at the Mid-State Correctional Facility in Marcy, N.Y., his lawyer Dirk Lorenzen said. The former CEO previously refused his wife’s demand for disclosure. His lawyers told a Palm Beach County, Fla., court he was never served with divorce papers, so disclosure wasn’t mandatory within 45 days of her July 31 filing.

Kozlowski’s financial information may be of interest to Tyco shareholders who sued him and the company. They are seeking to recover money lost when Tyco shares plunged after accounting problems became public in 2002.

“Clearly, he’s taking a view he is willing to play games,” New York attorney John Moscow, a former prosecutor, said. “It could be spite, or it could be he doesn’t want [Karen] or anybody else to know his assets.” "

2006 costly for Sheriff

2006 costly for Sheriff : ServeNow.com: "It was a busy year for the Pratt County Sheriff's Department in 2006. They spent a lot of time on the road transporting prisoners and a lot of money on juveniles in 2006.

The budget for juveniles was $10,000 but one subject alone cost thes department $13,000 and the total cost for housing juvenile offenders was just over $23,000. By law, juvenile offenders can not be kept in the Pratt County Jail so they must pay to have them housed elsewhere.

'This was one of the costliest years in the history of this department for housing juvenile offenders,' said Pratt County Sheriff Vernon Chinn.

Juveniles accounted for 90 percent of the 33 burglaries in 2006 which was double the 17 in 2005. Nearly all burglaries were solved and some cases are in the process of being prosecuted, Chinn said.

While money flowed out for juvenile care, money came in for inmate care in Pratt from other facilities. The county took in $41,000 for inmate care and just over $4,000 for civil process fees. "

Hundreds On the Hook

GilroyDispatch.com of Gilroy California: "Efreen Gonzalez' voice quivered as he stood before the court. He could not afford to have his bank account emptied, he struggled to explain, over a lawsuit he never had a chance to fight. After all, no one told him his car was towed, no one told him it was sold, and no one told him he'd been sued by the towing company for storage and legal fees.

Despite his pleas last summer, Gonzalez lost the case and had nearly $4,000 drained from his bank account.

'This is the United States, where everything goes by the law,' said Gonzales, 37, a father of three who moved from Jalisco, Mexico 20 years ago. 'I don't think the law worked in my case.'

Gonzalez is one of hundreds of unsuspecting motorists dragged into court by former tow truck operator Paul Greer, who was blacklisted out of business by the California Highway Patrol in 2004 after they accused him of posing a 'criminal threat' to the community.

But even after being effectively shut down by the CHP's action - honored by every law enforcement agency in the region - Greer turned the remnants of his business into a small claims court money machine whose suspect practices, measured by a slew of complaints in two counties, have gone largely unchecked by judges, district attorneys and law enforcement agencies."

The premier was reportedly posted prior to the live airing of the show and Fox reportedly found out about it on the 8th of this month. The specific profile of the person who uploaded the video was 'ECOTotal' and his account has already been suspended on YouTube. A U.S. District Court for the Northern District of California granted the subpoena on January 18. Reuters and the Hollywood Reporter have some more details on the story."

20th Century Fox served YouTube with a subpoena Wednesday demanding the Google-owned viral video site disclose the identity of a user who uploaded copies of entire recent episodes of primetime series '24' and 'The Simpsons.'

The subpoena, which first came to light on the blog Google Watch was granted by a judge in U.S. District Court for the Northern District of California after being filed by the News Corp.-owned studio on Jan. 18. It is not yet known whether YouTube has complied with the request.

In addition, a second, lesser-known video site, LiveDigital, was also served with a similar subpoena.

A Fox spokesman confirmed the subpoena was filed to both YouTube and LiveDigital and served but declined further comment. A spokesman for YouTube declined comment.

The '24' episodes in question actually appeared on YouTube prior to their primetime Jan. 14 premiere on the Fox broadcast network, which spread four hourlong episodes of the hit drama over two consecutive nights. Fox became aware the episodes were on YouTube on Jan. 8, according to the subpoena.

According to court documents, Cox executed the eviction of Lakishia Wiley and her four children Dec. 26 from a three-bedroom house in Easton that was his wife's childhood home. The house is in Cox's southeast Gregg County precinct.

According to state law, 'a constable who is a party to or interested in the outcome of a suit may not serve any process related to the suit.'

Cox has not responded to requests for comment. Violating the law regarding process serving could result in a contempt of court ruling and a fine of between $10 and $100.

Cox could have appointed a deputy constable to serve the eviction notice, but he would have been required to request a deputy in writing to the county commissioners court.

County Judge Bill Stoudt says neither he nor commissioners have received a request for a deputy constable in the matter."

Nanci Dion, a single mother and unemployed nurse who lives in Somers, has spent the last few months sending personal financial information to representatives of three record companies that are suing her based on claims that her computer was used to trade copyrighted songs.

Advertisement 'They want my bank accounts. They want my mortgage papers. They want my medical records,' Dion said in an interview last week.

The record companies - Warner Brothers Records Inc., UMG Recordings Inc., and Sony BMG Music Entertainment - want information on all her credit cards, specifically the available credit on each. She finds that request particularly frightening.

'I'm deathly afraid they're going to take my credit,' says Dion, who lives in a modest ranch house on Sunset Drive in Somers with her son, Jonathan, 15.

Dion has been giving her financial information to the record companies under what they call a 'voluntary hardship program.' In other words, they are holding out the possibility of a reduced settlement offer, possibly with an installment payment plan, if she can demonstrate financial hardship.

A vacation property management company that closed following allegations it defrauded its clients has been ordered to pay at least $75,000 to three of the homeowners it once did business with.

Minneola lawyer Edward P. Jordan II has won judgments in Circuit Court in Bartow for three former clients of Yvonne's Property Management Inc., which closed its office on Waverly Barn Road in August.

Jordan had filed breach of contract lawsuits on behalf of Ben Gilbert, Raymond Gillanders and John Clark, all British residents who own vacation homes in the Polk County portion of Four Corners and had hired Yvonne's to manage those homes for them.

The owners of Yvonne's, Walter and Yvonne Bernstein, did not show up in court for any of the three hearings and three separate judges found in favor of the homeowners, issuing final judgments by default.

The problem now is finding the Bernsteins to collect.

'We don't know where they are,' Jordan said. 'I don't know how much money my clients are willing to spend to find them.'

After Clark and his Saints teammates checked in to their hotel Saturday -- as fans belted out their longtime chant, 'Who dat?' -- a private detective snagged him with court papers, alerting Clark he'd been named in a paternity suit by a Chicago woman.

Clark, who was all-conference as a quarterback and linebacker at Hillcrest High in Country Club Hills and played at the University of Illinois, was getting into a stretch SUV outside the Hyatt Regency McCormick Place when Michael Slevnik caught him.

'I'm sorry about this,'' Slevnik told Clark, who wears No. 54 -- the same number as the Bears' Brian Urlacher, whose paternity problems played out early in the season.

After Slevnik explained the nature of the suit, which Clark politely acknowledged, he advised Clark to show the papers to his attorney. Then he wished Clark luck.

'I had my figures crossed,' said Slevnik, a rabid Bears fan who waited three hours in the hotel lobby for his mark.

'This was interesting'

Slevnik passed most of the day on an overstuffed chair -- conspicuous in a gray business suit and black overcoat with a manila envelop tucked under his arm -- plotting how he would get to Clark. As the afternoon passed, the sea of black and gold swelled, and the "Who dats" got louder.

Thefts down in county; burglary, molesting cases up

The Wabash Plain Dealer Online: "Thefts are down but burglaries are up slightly. Child molesting cases are way up, but traffic accidents involving injury or death are down almost as dramatically.

Sheriff Leroy Striker's annual report contains lots of information - nuggets enough to both satisfy and slightly alarm citizens and taxpayers.

It's all in a statistic-packed five page report from Striker summarizing Wabash County Sheriff's Department activity and activity at the jail in 2006.

Jail overcrowding remains one of the issues, but there were important developments on that front: Though the average daily population of the jail increased from 87.7 in 2005 to 92.7 in 2006, the sense of being overcrowded perhaps lessened a bit because some remodeling increased the rated capacity of the facility from 60 to72.

A long term trend continued in 2006: Fewer total bookings at the jail, but longer stays by those in jail. The result: Daily jail population remains generally on an upward course.

Jail bookings dropped about 100 per year, each year between 2002 and 2006. But during those same years, the average length of stay increased from 17.2 days to 26.76 days. As a result the average daily population increased during those years from 80 to 92.69."

City to vote on using cameras to nab speeders | www.tucsoncitizen.com ®: "Tucson motorists could fall under the gaze of cameras installed at intersections to catch red-light runners and on vans to catch speeders under a plan the City Council will consider Tuesday.

The Tucson Police Department could launch a yearlong program testing a variety of cameras along city streets if the council approves it.

A public hearing would take place before the vote.

Police Lt. Mike Pryor said cameras would not be used for surveillance and would capture only images of motorists speeding or running red lights.

Last year the department responded to 16,000 collisions in which 5,000 people were injured and 57 killed.

Pryor said those numbers can be reduced with photo radar enforcement targeting speeders and red-light runners.

'All those things cause crashes and cause them to be worse,' he said. 'When you increase traffic awareness, people commit fewer violations.'"

Beloit City Council reflects on progress

Beloit Daily News: "The Beloit City Council took time out Tuesday to reflect on the accomplishments of the city during 2006, while Council President Marty Densch reported the annual State of the City address.
Overall, Densch deemed that “not only is the city sound, but continues to improve in nearly every measurable way,” listing residential and economic development, the creation of jobs and the commitment of citizens as contributions to a successful year.

Specifically, Densch mentioned Deerfield Estates, Atlanta Bread Company, Heritage View and the looming Beloit Casino project as major accomplishments, among many others.

In 2006, the average home value in Beloit grew by 6.1 percent, and the tax base grew by 8.1 percent, to $1.49 billion, Densch reported. Six new businesses were added to Beloit, with the expansion of nine existing businesses, creating 584 new jobs and a $93 million investment in the economy. "

The papers keep piling up, and they do little good until they're served.

Sheriffs around East Tennessee say they're struggling to deal with a backlog of outstanding warrants. Hamblen County Sheriff Esco Jarnagin estimates that he inherited nearly 9,000 warrants when he took office in September, all of them waiting to be served.

'There are a lot of felonies, and there are a lot of misdemeanors. There are time limits on some of them. Some of the people involved have died or moved out of state.'

Other sheriffs say they're seeing the same kind of problem.

'Some of them are simple things like bad check warrants,' Grainger County Sheriff James Harville said. 'But we're the ones who have to serve them.'

In an era of budget cuts and manpower shortages, some sheriff's departments do without process-server jobs. That leaves court papers to be served by deputies already busy with regular patrol duties. "

She is being sued for allegedly being involved in a scam that cheated California investors out of more than $500,000 -- a claim she heatedly denies.

And when he did finally serve her, at a community meeting Dec. 9, Coleman handed the document to an aide, and it promptly went into the garbage, according to allegations in court records. "

John R. McKinnon, an attorney for the owners of the trailer park, said Friday the five tenants served the notices have time to bring their late rent up to date so as to avoid being evicted. In some cases people are four and five months behind on their rent, he said."

The Hutchinson News, Hutchinson, Kans. | Local News: "Eyebrows rose in Reno County Commission chambers over the Sheriff's Department's purchase of a 1999 Pontiac Grand Prix, complete with spoiler, sunroof and leather interior.

It wasn't the $8,500 price for the vehicle sold by Conklin Cars, Hutchinson, as much as the lack of sealed bids that concerned officials.

Sheriff Randy Henderson, an elected official with funds in his budget to cover the cost, was not required to seek a commission vote on the purchase, County Counselor Joe O'Sullivan said.

Fiscal Administrator Tim Davies and O'Sullivan are developing an overall county purchasing policy, though, that would address such acquisitions in the future.

'I think that's what Dennis (Undersheriff Stofer) has been asking for all along,' Henderson said.

The manner in which the Grand Prix was bought was not unusual for the department.

An officer who delivers civil papers, such as subpoenas, will develop the specifications for the used vehicle and then shop at different dealers for models. The process servers who go out to rural areas, for example, will shop for four-wheel-drive vehicles, Stofer said."

One2One Learning Foundation (2006) 39 Cal.4th 1164—which was decided just before the rehearing of Knapp’s appeal—the justices held that PCHS was not a “public entity” subject to the act because it operates independently of LAUSD.

In Wells, the high court held that various charter schools being sued by distance learning students did not qualify as “public entities” because they were not operated by the public school system. The schools’ only relationship with the chartering districts was through the charters, the court noted, and they acted autonomously in regard to their finances, legal matters and management.

Justice Laurie D. Zelon, writing for Div. Seven, reasoned that PCHS is similarly independent of its chartering authority.

As an alleged nonprofit public benefit corporation, she said, it is a separate legal entity that has its own board of directors and authorized agent for service of process, operates on its own budget, and hires its own administrators and teachers.

Buffalo News - McGahee sued for paternity: "Buffalo Bills running back Willis McGahee is facing his third paternity suit in two years, according to the Miami Herald.

Keisha Walls, 27, an elementary school teacher, claims McGahee is the father of son Kai Walls, who was born April 19, 2006. McGahee also fathered Willis McGahee IV, born Jan. 6, 2006 to Chiniqua Smith, 26, and Bria McGahee, born Jan. 17, 2005 to Dorothy Doretha McNeil, 29. McGahee, 25, was declared the biological father in those cases and is paying child support.

The Miami Herald reported that Walls met McGahee in Miami during a college break. Walls was married at the time, but said she was estranged from her husband when Kai was conceived. They are now in divorce court. Her husband took a paternity test, which she said was negative.

'I don't sleep around,' Walls told the Herald. 'It was Willis.'"

Former Hill staffer Robert Steinbuch, who is suing ex-girlfriend Jessica Cutler in federal court for describing their liaisons on her notorious sex blog, got permission from a judge last fall to add Cox -- whose former employer, the snarky political blog Wonkette, first publicized Cutler's online diary -- as defendant. In a filing last week, Steinbuch's lawyer complained that he was having trouble finding Cox to serve her papers: First he had the wrong address, then she ignored the notices a process server left at her house. On one visit, the server 'observed that someone was in Cox's house and refused to answer the door.'"

Scooby Doo, Magnum PI and the '8 other best private detectives of all time'

The Staff at PInow.com, a worldwide directory of investigators, have gathered a list of the most interesting, sexy, and cool detectives and PIs of all time.

You watch them on TV, you read about them in your favourite novels and watch them on the old silver screen, but how do your favourite PIs and detectives fare against the best of the best? Read on:

10) Scooby-Doo and Those Pesky Kids (Fred, Daphne, Velma, and "Shaggy"). First an animated show and then a cultural phenomenon, this is where most of us first learned about detective work. The members of “Mystery, Inc.,” are definitely unlicensed, but few professionals make driving around in an old van and uncovering old crooks dressed as ghosts look so cool.







9) Inspector Jules Maigret. The French do it, too. Georges Simeon’s police inspector was streetwise, kind, and unassuming as he solves Paris’s crimes and worked for the Parisian police.







8) Hercule Poirot. Agatha Christie’s Belgian detective appeared in more than 50 short stories and 30 novels. The very neat detective with the huge moustache and small frame was one of the eccentrics of the private eye world, worrying about his shoes and his stomach with all the fussiness of an old maid. For all that (and maybe because of it) we rather like the old chap.







7) The Shadow. The character created by Walter B. Gibson is pulp hero, appearing in movies, books, comic books, and radio shows. With a mysterious past, the Shadow lurks out of sight, solving crimes.







6) Dashiell Hammett’s Sam Spade hails from the macho era of hard-boiled detectives. No great sensitivity here, just fedoras and plot twists and turns aplenty. Whether you are reading Hammett’s short stories or watching or reading The Maltese Falcon, it’s hard not to admire Sam. We always did like the strong, silent types.







5) Remington Steele. The title character of the TV show that made Pierce Brosnan a household name wasn’t even part of the show initially. In the show, it is Laura Holt who is a private detective. When she finds that few clients are willing to work with a female detective, she invents an imaginary superior named Remington Steele. The fake name is eventually adopted by Brosnan’s character.







4) Magnum, P.I. In this 80s television show, Thomas Magnum (Tom Selleck) was a private investigator working in Hawaii. With a tropical background and that famous, cool moustache, what’s not to love?







3) Jessica Fletcher from Murder, She Wrote was the ultimate in nosey, loveable armchair detectives. Jessica was the one that taught all would-be authors that every book tour for mystery authors ended in a mystery or a murder.







2) Addison and Hayes. Where would we be without those wacky 80s PI shows? In this classic, Blue Moon Detective Agency has two partners, Madolyn 'Maddie' Hayes (Cybill Shepherd) and David Addison (Bruce Willis), who solve crimes each week while bantering.







1) Sherlock Holmes, the fictional character that author Sir Arthur Conan Doyle grew to hate, was the first one to make a deerstalker cap and magnifying glass something besides hopelessly geeky. Maybe his mastermind and cool, scientific reasoning made him more like a Star Trek Captain than a sexy James Bond, but at least Holmes was having fun snorting coke and playing his violin at 221B Baker Street.

For truckers, new ID means background check - again (The Virginian-Pilot - HamptonRoads.com/PilotOnline.com): "Truck drivers must pay for a federal background check to get the license they need to haul hazardous cargo. They must pay for a federal background check to move freight for the Department of Defense and another for the Department of Energy. And if they want to take freight into Canada? That's one more they'll need.

This week, truckers learned of yet another check, a pricey investigation they will need to undergo to drive their big rigs in and out of U.S. ports, including Hampton Roads.

It's required to apply for a new federal ID called the Transportation Worker Identification Credential, which is intended to make the country's 360 ports more secure against terrorism by scrutinizing the backgrounds of port workers for crimes, immigration violations and terrorist activities.

About 750,000 port workers across the country, including longshoremen, truck drivers and mariners, will need to apply for the cards. At least 15,000 workers in Hampton Roads are expected to need the high-tech cards.

Each card carries a microchip storing the fingerprints of the card owner that will eventually be read by electronic scanners at the entrances of marine terminals and shipyards."

McCloy tried again and again, each time paying the court a $15 filing fee. All three times the summonses bounced back, even after he had checked the address with the post office.

'It's not the way the legal system should work,' McCloy said. 'Corporations shouldn't be allowed to do an end run around summonses properly issued.'"

...McCloy could have hired a process server, but serving papers to Island Recreational isn't easy, said James Edge, owner of County Express Process Service in Bellmore.
