Dale Van Wert, 48, of Garfield Township, has pleaded not guilty to 11 felonies and four misdemeanors stemming from allegedly operating his private process-serving company while on duty at the Bay County Court Facility from February to June of last year.

Additional charges alleging that he sexually assaulted a 13-year-old girl in December - charges that carry, upon conviction, penalties of up to life in prison - also are pending against Van Wert, though those charges weren't addressed in Monday's hearing.

Prosecutors allege that Van Wert misused his authority as a deputy to obtain information on people and vehicles to facilitate the operations of his business, Court Service Integrity.

While the Bay County Sheriff's Office often has a deputy serve court papers while on duty, the fees, which range from about $12 to $40, go to the county's general fund. It's against county policy for deputies to serve papers in Bay County outside of their capacity as public servants. "

cbs2chicago.com - Saint Served Paternity Papers In Chicago: "New Orleans reserve linebacker Danny Clark was served papers in a paternity lawsuit involving a Chicago-area woman after the Saints arrived at their hotel for today's NFC championship game.

A private investigator gave Clark the papers last night while he was getting into a sport utility vehicle outside the team's downtown hotel.

Clark wasn't available for comment before the game.

Alisha L. Pate claims Clark is the father of her three-week-old son. Pate's attorney says Clark's arrival in Illinois was the first opportunity to serve him.

Saints spokesman Greg Bensel says the team is aware of the lawsuit, but has no comment."

Jail getting new employee

American News | 01/03/2007 | Jail getting new employee: "An increased workload means a new employee at the Brown County Jail.

County commissioners Tuesday approved a new full-time clerical worker for the jail. Among other things, the worker will administer court-ordered breath tests to people on probation or involved in the judicial system and help with fingerprinting and issuing pistol permits.

Sheriff Mark Milbrandt gave the commission information that showed, on Dec. 20, the jail administered 146 breath tests to make sure people hadn't been drinking.

Other work has increased too.

Milbrandt said the county now issues pistol permits for both the city of Aberdeen and the county. When it handled pistol permits for only the county, about 100 a year were issued. Last year, including city numbers, 545 were issued.

The amount of legal paperwork has also increased, Milbrandt said. According to Milbrandt's numbers, the number of warrants received in 2006 was 2,941, up 412 from the year before. The number of civil papers served last year was 4,735 - 370 more than in 2005."

The Libby defense indicated in March 2006 court papers that Karl Rove will be a 'key witness' in the trial, and will testify concerning a conversation with Libby on July 10 or 11, 2003, regarding columnist Robert Novak's intent to print a story about Valerie Plame's employment at the CIA.

Trial watchers said the subpoenas make it clearer than ever that Libby's defense team will seek to put the Bush administration and its policies on trial."

Former Cumberland resident Kozlowski, 60, was served Thursday at the Mid-State Correctional Facility in Marcy, N.Y., his lawyer Dirk Lorenzen said. The former CEO previously refused his wife’s demand for disclosure. His lawyers told a Palm Beach County, Fla., court he was never served with divorce papers, so disclosure wasn’t mandatory within 45 days of her July 31 filing.

Kozlowski’s financial information may be of interest to Tyco shareholders who sued him and the company. They are seeking to recover money lost when Tyco shares plunged after accounting problems became public in 2002.

“Clearly, he’s taking a view he is willing to play games,” New York attorney John Moscow, a former prosecutor, said. “It could be spite, or it could be he doesn’t want [Karen] or anybody else to know his assets.” "

2006 costly for Sheriff

2006 costly for Sheriff : ServeNow.com: "It was a busy year for the Pratt County Sheriff's Department in 2006. They spent a lot of time on the road transporting prisoners and a lot of money on juveniles in 2006.

The budget for juveniles was $10,000 but one subject alone cost thes department $13,000 and the total cost for housing juvenile offenders was just over $23,000. By law, juvenile offenders can not be kept in the Pratt County Jail so they must pay to have them housed elsewhere.

'This was one of the costliest years in the history of this department for housing juvenile offenders,' said Pratt County Sheriff Vernon Chinn.

Juveniles accounted for 90 percent of the 33 burglaries in 2006 which was double the 17 in 2005. Nearly all burglaries were solved and some cases are in the process of being prosecuted, Chinn said.

While money flowed out for juvenile care, money came in for inmate care in Pratt from other facilities. The county took in $41,000 for inmate care and just over $4,000 for civil process fees. "

Hundreds On the Hook

He could not afford to have his bank account emptied, he struggled to explain, over a lawsuit he never had a chance to fight. After all, no one told him his car was towed, no one told him it was sold, and no one told him he'd been sued by the towing company for storage and legal fees.

Despite his pleas last summer, Gonzalez lost the case and had nearly $4,000 drained from his bank account.

'This is the United States, where everything goes by the law,' said Gonzales, 37, a father of three who moved from Jalisco, Mexico 20 years ago. 'I don't think the law worked in my case.'

Gonzalez is one of hundreds of unsuspecting motorists dragged into court by former tow truck operator Paul Greer, who was blacklisted out of business by the California Highway Patrol in 2004 after they accused him of posing a 'criminal threat' to the community.

But even after being effectively shut down by the CHP's action - honored by every law enforcement agency in the region - Greer turned the remnants of his business into a small claims court money machine whose suspect practices, measured by a slew of complaints in two counties, have gone largely unchecked by judges, district attorneys and law enforcement agencies."

The premier was reportedly posted prior to the live airing of the show and Fox reportedly found out about it on the 8th of this month. The specific profile of the person who uploaded the video was 'ECOTotal' and his account has already been suspended on YouTube. A U.S. District Court for the Northern District of California granted the subpoena on January 18. Reuters and the Hollywood Reporter have some more details on the story."

20th Century Fox served YouTube with a subpoena Wednesday demanding the Google-owned viral video site disclose the identity of a user who uploaded copies of entire recent episodes of primetime series '24' and 'The Simpsons.'

The subpoena, which first came to light on the blog Google Watch was granted by a judge in U.S. District Court for the Northern District of California after being filed by the News Corp.-owned studio on Jan. 18. It is not yet known whether YouTube has complied with the request.

In addition, a second, lesser-known video site, LiveDigital, was also served with a similar subpoena.

A Fox spokesman confirmed the subpoena was filed to both YouTube and LiveDigital and served but declined further comment. A spokesman for YouTube declined comment.

The '24' episodes in question actually appeared on YouTube prior to their primetime Jan. 14 premiere on the Fox broadcast network, which spread four hourlong episodes of the hit drama over two consecutive nights. Fox became aware the episodes were on YouTube on Jan. 8, according to the subpoena.

According to court documents, Cox executed the eviction of Lakishia Wiley and her four children Dec. 26 from a three-bedroom house in Easton that was his wife's childhood home. The house is in Cox's southeast Gregg County precinct.

According to state law, 'a constable who is a party to or interested in the outcome of a suit may not serve any process related to the suit.'

Cox has not responded to requests for comment. Violating the law regarding process serving could result in a contempt of court ruling and a fine of between $10 and $100.

Cox could have appointed a deputy constable to serve the eviction notice, but he would have been required to request a deputy in writing to the county commissioners court.

County Judge Bill Stoudt says neither he nor commissioners have received a request for a deputy constable in the matter."

Nanci Dion, a single mother and unemployed nurse who lives in Somers, has spent the last few months sending personal financial information to representatives of three record companies that are suing her based on claims that her computer was used to trade copyrighted songs.

Advertisement 'They want my bank accounts. They want my mortgage papers. They want my medical records,' Dion said in an interview last week.

The record companies - Warner Brothers Records Inc., UMG Recordings Inc., and Sony BMG Music Entertainment - want information on all her credit cards, specifically the available credit on each. She finds that request particularly frightening.

'I'm deathly afraid they're going to take my credit,' says Dion, who lives in a modest ranch house on Sunset Drive in Somers with her son, Jonathan, 15.

Dion has been giving her financial information to the record companies under what they call a 'voluntary hardship program.' In other words, they are holding out the possibility of a reduced settlement offer, possibly with an installment payment plan, if she can demonstrate financial hardship.

A vacation property management company that closed following allegations it defrauded its clients has been ordered to pay at least $75,000 to three of the homeowners it once did business with.

Minneola lawyer Edward P. Jordan II has won judgments in Circuit Court in Bartow for three former clients of Yvonne's Property Management Inc., which closed its office on Waverly Barn Road in August.

Jordan had filed breach of contract lawsuits on behalf of Ben Gilbert, Raymond Gillanders and John Clark, all British residents who own vacation homes in the Polk County portion of Four Corners and had hired Yvonne's to manage those homes for them.

The owners of Yvonne's, Walter and Yvonne Bernstein, did not show up in court for any of the three hearings and three separate judges found in favor of the homeowners, issuing final judgments by default.

The problem now is finding the Bernsteins to collect.

'We don't know where they are,' Jordan said. 'I don't know how much money my clients are willing to spend to find them.'

After Clark and his Saints teammates checked in to their hotel Saturday -- as fans belted out their longtime chant, 'Who dat?' -- a private detective snagged him with court papers, alerting Clark he'd been named in a paternity suit by a Chicago woman.

Clark, who was all-conference as a quarterback and linebacker at Hillcrest High in Country Club Hills and played at the University of Illinois, was getting into a stretch SUV outside the Hyatt Regency McCormick Place when Michael Slevnik caught him.

'I'm sorry about this,'' Slevnik told Clark, who wears No. 54 -- the same number as the Bears' Brian Urlacher, whose paternity problems played out early in the season.

After Slevnik explained the nature of the suit, which Clark politely acknowledged, he advised Clark to show the papers to his attorney. Then he wished Clark luck.

'I had my figures crossed,' said Slevnik, a rabid Bears fan who waited three hours in the hotel lobby for his mark.

'This was interesting'

Slevnik passed most of the day on an overstuffed chair -- conspicuous in a gray business suit and black overcoat with a manila envelop tucked under his arm -- plotting how he would get to Clark. As the afternoon passed, the sea of black and gold swelled, and the "Who dats" got louder.
