Serving Papers is Big Business in this MO County

By law, there are two things the sheriff's department is required to do: Run the jail and serve legal papers. And the business of serving papers is a booming one for the Cole County Sheriff's Department.

"We keep going up, and we're never going back down," said Lt. Wayne Kem, who heads up the civil division, which has seen the number of garnishments served go up 85 percent since 2005.

As of 2008, Cole County was third in the state in terms of the number of papers served, mainly due to the fact that it's the seat of state government.

Wondering what to do if a camera catches you speeding? Phoenix attorney Brian Cabianca says if you get your ticket in the mail, you don't have to pay it right away.

"They have to be served either by a police officer or a process server -- with the ticket -- and they have to be served in person," Cabianca said.

Missing Summons Almost Cost Kalamazoo County Agency $1 Million

A missing court summons nearly cost Kalamazoo County's public mental-health agency $1 million.

How it got lost and where the summons is now remains unclear.

In May 2006, a summons was served on the Kalamazoo Community Mental Health and Substance Abuse Services in connection with a wrongful- termination lawsuit filed by a former employee.

HC Refuses to Reinstate Trial Court Staff

Justice Hema Kohli dismissed a petition filed by Rishipal, a process server in Tis Hazari Court, challenging the April 2006 order passed by the Administrative Civil Judge terminating him from the job for not serving the summons twice in a probate case.

"The charges that were proved against the petitioner were serious in nature, the job of a process server, being an important ingredient in the smooth and efficient functioning of the courts," the Court observed.
